We operate the website, mobile application, and related services (collectively, the "Platform") that enables users ("you," "your," or "Users") to discover, book, create, and manage sporting events and communities locally and internationally.
By accessing or using the BallersHQ Platform, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use our Platform.
2. Definitions
- "Platform" refers to the BallersHQ website, mobile app, and all related services.
- "User" refers to any individual who accesses or uses the Platform.
- "Arena" refers to a User who creates, organizes, and manages a sporting event or community on the Platform.
- "Player" refers to a User who books a spot and attends an event created by an Event Host.
- "Content" refers to any text, graphics, images, music, software, audio, video, information, or other materials posted on the Platform.
3. User Accounts and Eligibility
- You must be at least 10 years of age (or the age of majority in your jurisdiction) to use the Platform.
- You are responsible for providing accurate registration information and keeping your account credentials secure.
- You are solely responsible for all activities that occur under your account.
4. Services Provided
BallersHQ provides a digital marketplace that facilitates:
- The discovery of local and international sporting events (e.g., pick-up basketball games, soccer tournaments, running clubs).
- The booking and payment processing for spots in these arenas.
- The creation and management of sporting events and communities by Arenas and players.
- Communication tools for Users and Event Hosts to coordinate.
5. Arena Responsibilities
If you create an event as an Arena, you agree that you:
- Are solely responsible for the accurate description, timing, location, and pricing of your event.
- Will provide a safe environment for Participants, ensuring the venue and activities are appropriate for the sport.
- Will comply with all applicable laws, regulations, and venue rules.
- Understand that BallersHQ is not liable for any injuries, damages, or disputes that arise during your Arena.
- Are responsible for setting and communicating any eligibility requirements for your Arena (e.g., skill level, equipment needed).
6. Player Responsibilities
As a Player, you agree that you:
- Are responsible for reading the full event description before booking, including the required skill level, equipment, and rules.
- Will treat Arenas, other players, and facilities with respect and good sportsmanship.
- Understand that participation in sporting activities involves inherent risks of physical injury, and you voluntarily assume all such risks.
- Are responsible for your own health and safety and ensuring you are in adequate physical condition to participate.
7. Payments, Fees, and Cancellations
- Payment Processing: All payments for event bookings are processed securely through our third-party payment partners. By booking an event, you authorize us to charge your chosen payment method.
- Service Fee: BallersHQ may charge a service fee for the use of the Platform, which will be disclosed to you before you confirm a booking.
- Cancellation by Participant: Cancellation policies are set by the individual Arena. You are subject to the refund policy stated on the event page at the time of your booking.
- Cancellation by Event Host: If an Arena cancels an event, Participants will receive a full refund.
- Cancellation by BallersHQ: We reserve the right to cancel or suspend any event that violates these Terms. Users will be notified and refunded.
8. User Conduct and Content
You agree not to:
- Post false, misleading, or fraudulent Content.
- Use the Platform for any illegal or unauthorized purpose.
- Harass, bully, intimidate, or harm other Users.
- Upload or transmit viruses or any other malicious code.
- Infringe on any third party's intellectual property, privacy, or other rights.
- Use the Platform to send unsolicited commercial communications ("spam").
9. Intellectual Property
- The BallersHQ Platform, its original content, features, functionality, and logos are owned by the Company and are protected by international copyright, trademark, and other intellectual property laws.
- You retain ownership of the Content you post to the Platform. However, by posting Content, you grant BallersHQ a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and modify that Content for the purpose of operating and promoting the Platform.
10. Disclaimer of Warranties and Limitation of Liability
- The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. BallersHQ makes no warranties, expressed or implied, regarding the Platform's availability, reliability, or fitness for a particular purpose.
- You participate in events at your own risk. BallersHQ is not a party to the agreements between Event Hosts and Participants. We are not liable for any injuries, losses, damages, or disputes that occur during an event, or for the actions or omissions of any User.
- To the fullest extent permitted by law, BallersHQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform.
11. Indemnification
You agree to indemnify and hold harmless BallersHQ and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
We may suspend or terminate your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms.
13. Governing Law and Dispute Resolution
